Tytronix/Epic - Peter Picone - Supply Chain Risk

On July 15, 2013 Peter Picone was charged with selling counterfeit semiconductors that were intended for use in military applications:  http://www.justice.gov/opa/pr/massachusetts-man-charged-selling-counterfeit-semiconductors-intended-use-nuclear-submarines

On June 3rd of 2014, Peter Picone plead guilty to these charges.  http://www.justice.gov/opa/pr/massachusetts-man-pleads-guilty-importing-and-selling-counterfeit-intergrated-circuits-china

Oxygen Electronics has received a list of part number sold by Tytronix/Epic/Picone to Independent Distributors around the world.   There are 826 transactions between 2007 and 2012 documented where goods purchased from China by Tytronix/Epic and were sold to Independent Distributors.

Oxygen just completed an internal audit of our past transactions for the part numbers documented on this list and are pleased to report that our supply chain was not compromised by this new information.

Rhose Island Electronic Parts Company Admits to Defrauding Customers

According to justice.gov, Jeffrey Warga of Bay Components LLC waived his right to indictment and pleaded guilty to one count of conspiracy to commit wire fraud.  According to the court documents and statements, Warga and others participated in a scheme to defraud their customers by falsely representing electronic parts they  sold "were not from Asia when, in fact, the parts had been purchased from companies located in Asia". Massachusetts Man Pleads Guilty to Importing & Selling Counterfeit IC's

According to justice.gov, Peter Picone of Methuen, Massachusetts pleaded guilty to importing thousands of counterfeit integrated circuits from China and Hong Kong and reselling them to U.S. Customers. 

After searching Picone's business and residence, federal agents recovered 12,960 counterfeit ICs.

The court filings state, from 2007 through 2012, Picone and his suppliers in China and Hong Kong conspired to sell counterfeit integrated circuits marked with manufacturer marks including Motorola, Xilinx, and National Semiconductor. "Picone sold counterfeit ICs to contractors knowing that they would be supplied to the United States Navy for use in nuclear submarines." When parts were tested by the U.S. Navy and one of it's contractors, resurfacing to change the date code and to affix counterfeit marks was revealed.

Semiconductor Sales Up In February 2014

According to the SIA, Semiconductor Industry Association, semiconductor sales have risen 11.4% compared to February 2013. This mark's the industry's largest year-to-year increase in more than three years. On April 4th, 2014, SIA announced that worldwide sales of semiconductors reached $25.87 billion for the month of February 2014.
 
Brian Toohey, president and CEO or SIA, states “The trend lines remain positive for the global semiconductor industry, which has followed record revenues in 2013 with an encouraging start to 2014".

Pennsylvania Man Pleads Guilty to Selling Counterfeit Goods

According to ice.gov, a Pennsylvania man pleaded guilty to conspiracy to traffic counterfeit goods, including counterfeit military goods. This plea follows an investigation led by U.S. Immigration and Customs Enforcements (ICE).  Hao Yang imported counterfeit goods from China and fraudulently sold them as legitimate merchandise.

Between March 2011 and April 2013, Yang received hundreds of shipments from China and Hong Kong. Shipments included parts such as integrated circuits, to computer software. Yang and his co-conspirators operated in Maryland, Pennsylvania, and elsewhere.

According to HSI, Homeland Security Investigations, Special Agent William Winter. "These counterfeit military goods pose a threat to our national security as they could end up in the wrong hands and legitimate manufacturing and high technology businesses may believe they are receiving authentic goods".

The Pentagon: Supply Chains Must Be Safe

According to Bob Metzger, a government contract lawyer of Rogers Joseph O'Donnell, states that the Pentagon is putting its technology contractors "under a microscope".  Federal customers have heightened the standards on protecting their networks from supple chain risks.

According to the new statute and rules, federal customers will not have to give an explanation of the denial of parts from any outside source. This statute is in place because the vendors themselves should have a secure standard to purchase within the safest possible supply chain. Metzger claims this will be a problem in the near future in a matter of due process. Vendors and contractors will want to have a second review or documented government reviews. As this will require a high DOD approval, the vendors would have no knowledge to object or seek review.

Although some aerospace contractors have a leg up on other contractors, Metzger states that even though these companies have optimum measures for contracts, some jobs need obsolete products. Contractors then have to go to an outside source, which ups the risk of counterfeit goods or parts that include malicious code.

The Dangers of Component Resale

According to electronicspurchasingstrategies.com, the suit filed against Flextronics by chip manufacturer Xilinx Inc. is a "classic example" of a common practice in the Component world: the resale of excess inventory by OEMS and EMS companies.

Independent distribution and broker market has become one the top channels for component resales. With this being said, the concern is opening the door for high prices and the more pressing matter, counterfeit products. "Bogus parts are often mixed with authentic parts and returned to authorized distributors that take back inventory based on contractual obligations. Sometimes, counterfeits are reintroduced into the supply chain through authorized channels. Most of the time they pass through various channels until they are flagged — often, by an OEM."

Unsealed Lawsuit Alleges Military Safety Gear Made With Counterfeit Microchips

According to WFLA.com, a lawsuit that has been recently unsealed by a federal judge, shows that the U.S. Military safety gear was made with counterfeit microchips.

This suit filed by Conax on behalf of the US Government alleges the company knowingly sold counterfeit and/or defective safety gear to NASA without letting the Department of Defense contractors aware. The microchips were being used in SEAWARS. "SEAWARS separates pilots who eject into water from their parachutes with an electrically triggered explosive charge in order to keep them from drowning in their rigging." This lawsuit began because of an unusual high failure rate in testing.
