Global shipments of semiconductors, as compiled by the Semiconductor Industry Association and reported by www.economy.com, have been decreasing since November of 2011.

Epic International Electronics: Investigation

According to Eagletribune.com, the DCIS, NCIS, and and the US ICE has once again searched and seized suspect counterfeit parts from the company called Epic International Electronics, Inc..

According to the US Government, this is an ongoing investigation and agents were seen carrying boxes of "unknown" goods out of the house.

Epic International Electronics Inc. sold capacitors, fuses, semiconductors and have warehouse locations in the U.S., Europe, and Asia.

Suspect Counterfeit Parts & Internet Purchasing Platforms

According to the United States Government Accountability Office or GAO, suspect counterfeit electronic parts can be found on internet purchasing platforms.

The GAO created a fake company and were able to gain membership to multiple Internet platforms giving them access to vendors selling military-grade electronic parts. The GAO requested quotes from numerous vendors asking for 16parts which were 1)authentic part numbers for obselete and rare parts, 2) authentic part numbers with post production date codes, 3) bogus or fake part numbers that are not associated with any authentic parts.

The parts were sent to a third party test house. The testing concluded that all parts were either suspect or bogus parts. "Each part failed mulitple component analyses, including visual, chemical, X-ray, and microscopic testing" (pg.8).

2012 US National Defense Authorization Act: Not to Succeed?

According to EBI.com, the 2012 US National Defense Authorization Act may not succeed.

The Act states that "contractors" are responsible for avoiding and detecting counterfeit parts, not component manufacturers or distributors. These responsibilities include: avoiding the use of counterfeit parts, the rework or corrective action of counterfeit parts, and many more.

As said by Barbara Jorgensen, EBN Community Editor, component manufacturers should also be responsible for the prevention of distribution of counterfeit or suspect counterfeit parts. Because of waste and recycling regulations, manufacturers must go to an outside source to be destroyed. On the way, parts get diverted and enter the supply chain.

California Business Owner Sentenced for Conspriring to Sell Counterfeit Microelectronics

Mustafa Abdul Aljaff, a business owner from Newport, California has been sentenced to 30 months in prison for conspiring to sell counterfeit products to the United States military, and others between September 2007 to August 2009.

In January 2010, Aljaff plead guilty to federal charges of conspiracy to traffic in counterfeit goods to defraud the United States, and trafficking in counterfeit goods. As part of his plea agreement, Aljaff must pay restitution to the semiconductor companies whose trademarks were infringed. Also, Aljaff had to forfeit all machinery from his business location.

According to U.S. Attorney Machen, “Today’s prison sentence sends a message to the unscrupulous counterfeiters who put us all at risk by selling phony integrated circuits that end up in our military systems, medical devices, and consumer products.”

National Defense Authorization Act for Fiscal Year 2012

On December 30, 2011, President Obama signed H.R.1540 - National Defense Authorization Act for Fiscal Year 2012 into Law.  Included in this Act are several pages of very specific and very strong language dealing with the traffic and trade of counterfeit  electronic parts.

Page 196, Section 818 titled "Detection and Avoidance of Counterfeit Electronic Parts. 

This law requires that within 180 days of enactment, the Department of Defense shall establish policies and procedures by which the DoD can effectively manage the risks associated with counterfeit goods.  Within 270 days of enactment, these requirements must be flowed down to suppliers to address the detection and avoidance of counterfeit electronic parts.  Additionally this Law will result in requirements for reporting instances of counterfeit goods as well as the imposition of increased fines, penalties, and imprisonment for those who sell counterfeit goods.

Attorney General Holder Announces Campaign to Combat Demand for Counterfeit Products in Partnership with the National Crime Prevention Council WASHINGTON –

Attorney General Eric Holder and the Department of Justice’s Bureau of Justice Assistance, in collaboration with the National Crime Prevention Council (NCPC), today announced a new public education campaign to combat the purchase and sale of counterfeit and pirated products. The campaign, launched at the White House, will educate the public on various forms of intellectual property theft, from counterfeit consumer goods and pharmaceuticals to illegal downloads and other pirated materials. The campaign will highlight the potential health, safety and economic consequences for American citizens.

Intellectual property (IP) crime refers to the violation of criminal laws that protect copyrights, patents, trademarks, other forms of intellectual property and trade secrets, both in the United States and abroad. IP crimes can destroy jobs, suppress innovation in the United States and jeopardize the health and safety of consumers. In some cases, these activities are used to fund dangerous or even violent criminal enterprises and organized crime networks.

"As our country continues to recover from once-in-a-generation economic challenges, the need to safeguard intellectual property rights – and to protect Americans from intellectual property crimes – has never been more urgent,” said Attorney General Holder. “Through this new public education campaign, we are encouraging the American people to become vigilant partners in identifying and disrupting intellectual property crimes. With their help, I am confident that we can build upon our recent successes in combating intellectual property theft, bringing criminals to justice and protecting consumers and innovators.”

“Intellectual property theft is not a victimless crime – it affects everyone and damages our economy,” said Assistant Attorney General for the Office of Justice Programs Laurie O. Robinson. “We are proud to work with the White House and NCPC toward reducing the demand for counterfeit products through educating the public about intellectual property crime.”

The campaign includes “Premonition,” a television public service announcement (PSA) created in partnership with MTV Networks that illustrates how IP thefts link to gangs and other criminal activities and “It Hurts,” an online video that demonstrates how IP theft is stealing. The campaign also includes radio and print ads as well as campaign materials delivered via social media tools – videos, podcasts and web banners. Attorney General Holder and Assistant Attorney General Robinson were joined at today’s campaign launch by Intellectual Property Enforcement Coordinator in the Executive Office of the President Victoria Espinel, Director of Immigration and Customs at the Department of Homeland Security John Morton, Acting Deputy Secretary of Commerce Rebecca M. Blank, and President and CEO of the National Crime Prevention Council Ann M. Harkins.

Senate Armed Services Committee Hearing On Counterfeit Components - Complete

On Noverber 8th, 2011 the Full Membership of the Senate Armed Services Committee heard testimony from multiple members of the supply chain for electroinc components ranging from independent distribution to component manufacturers to prime contractors.

It was universally agreed that Counterfeit Components in the supply chain have become a major issue and participation by all fascets of the supply chain are required in order to mitigate the risks.
